Privacy policy
What we collect when you send an enquiry, where it goes, how long we hold it, and the rights you have over it.
1. About this policy
Top Sellers Realty Pty Ltd (ABN 32 682 667 143) publishes this site and this policy. In it, "we" and "us" mean Top Sellers Realty Pty Ltd, and "you" means a person who uses this site or sends us an enquiry through it. We handle personal information under the Privacy Act and the Australian Privacy Principles made under it.
This policy covers the website. It also covers the information we collect when you deal with us away from it, for example under an agency appointment, a tenancy or a property management arrangement. Last updated 13 August 2026.
2. What we collect
We collect only what you type into a form. You can read every page on this site without telling us anything about yourself.
An enquiry form collects your name, your email address, your phone number, the subject you select and the message you write. An enquiry sent from a property page also carries that property's listing reference, its address and the address of the page you sent it from, so our reply is about the right property. Your name and your email address are the two fields we need in order to answer you. A phone number is optional and we use it only to call or text you back.
The rental application form collects what a tenancy application needs: your name and contact details, your current address and rental history, your income and employment or benefit details, an emergency contact, a personal referee, and the names of other adults applying with you. It also collects contact details for people other than you, such as your referee, your employer and your current agent. Provide those only with their knowledge, and we contact them only to verify your application, with your consent recorded on the form.
The address box on our enquiry form suggests addresses as you type. To do that, your browser sends what you have typed in that one box to Geoscape Australia, which runs the national address file the suggestions come from. It happens while you type, before you send anything, and it carries only those characters: not your name, your email, your phone number or anything else on the form. Nothing is sent until you have typed at least three characters, and you can ignore the suggestions and type the address yourself.
Please keep sensitive information out of a message. We do not collect it here. It means things like health information and information about your race, your religion and your political views.
As any web host does, Netlify keeps technical records of the requests made to this site, which can include an IP address, a browser type and the page requested. The hosting service creates those rather than us, and we do not use them to identify you or to work out who visited a page.
3. What this site does not do
This site runs no analytics, no advertising pixels and no tracking scripts of any kind. It sets no cookie for analytics or advertising, it builds no profile of your visit, and it does not follow you to another site. The three calculators work entirely in your browser: they save nothing you type and they send us nothing. The address suggestions in section 2 are the one thing this site sends anywhere before you press a button, and the locality maps on our property pages are plain images, so looking at one tells nobody anything.
No computer program here makes a decision about you, because a person reads and answers every enquiry. We do not sell, rent or trade personal information, and we do not disclose it overseas for marketing.
4. Why we collect it
We use your information to answer your enquiry, to talk with you about buying, selling, renting or managing a property, to send you what you asked for, and to keep the records a licensed agency in Queensland has to keep. We also use and disclose it where a law requires or allows it, including the identity checks and record keeping that apply to a real estate business.
If we ever want to use your information for something other than the reason you gave it for, we ask you first, unless the law allows the use without your consent.
5. Marketing and messages
We send a commercial email or text only where you have consented, either because you told us we could or because you asked us about a property and would expect to hear from us about it. Every commercial message identifies us, gives you a way to contact us and carries a working unsubscribe link, and we act on an unsubscribe request without asking for a reason.

6. Who else handles it, including overseas
Netlify hosts this site and Netlify is based in the United States. Your form submission travels to its servers and is stored there before it reaches us, so your information is disclosed to a recipient overseas, and the United States is the country we expect it to be handled in. We stay accountable for information we disclose that way, and before we disclose it we take reasonable steps to see that the recipient handles it to the standard we do.
Geoscape Australia answers the address suggestions described in section 2. It trades as Geoscape and is the registered company PSMA Australia Limited, owned by the nine Australian governments, and it is the body that publishes the national address file. It is based in Australia, so those characters do not leave the country, and it receives nothing else you type on the form.
Within Australia we disclose your information to the people you would expect us to involve in the work you asked us to do, such as a seller or a landlord we act for, and to our professional advisers, and we disclose it where a law, a court or a regulator requires it.
7. Keeping it safe
We take reasonable steps to protect personal information from misuse, loss and unauthorised access, change or disclosure. No system carries a guarantee. Information sent to us over the internet passes through networks we do not control, and we cannot promise that a transmission is completely secure.
Where we suspect a data breach we assess it, and we take all reasonable steps to finish that assessment within 30 days. Where a breach is likely to cause serious harm and we cannot head that harm off, we notify the Office of the Australian Information Commissioner and the people at risk as soon as we can, and the notice says what happened, what information was involved and what to do about it.
8. How long we keep it, and how to see it
We keep personal information only while we need it for the reason it was collected, or while a law requires us to hold it. Records tied to a property transaction carry retention periods set by law, and those run for years after the transaction finishes. When we no longer need information and no law requires it, we destroy it or de-identify it.
You can ask what we hold about you, ask for a copy, and ask us to correct anything wrong, out of date, incomplete or misleading. Email info@topsellersrealty.com.au or call 0431 871 359. We may need to confirm who you are first, and we aim to answer within 30 days. Asking costs nothing. If a charge applies to giving you access it will not be excessive, and we tell you what it is beforehand. If we refuse access or a correction, we tell you in writing why, and how to complain.
9. Complaints
If you think we have mishandled your personal information, tell us first. Email info@topsellersrealty.com.au with "Privacy complaint" in the subject line, or write to PO Box 1940 Sunnybank Hills QLD 4109. We acknowledge your complaint and give you a written answer within 30 days.
If that answer does not satisfy you, or none arrives in time, take the complaint to the Office of the Australian Information Commissioner at oaic.gov.au, which can investigate it and make a determination. A complaint about how we have acted as a licensed agent, rather than about your personal information, goes to the Office of Fair Trading Queensland. Our terms of use set out that pathway.
10. Changes, and how to reach us
We update this policy when the way we handle personal information changes, or when the law changes. The version published on this page is the current one, and the date in section 1 tells you when it last changed.
